1. Scope

These Terms and Conditions apply to the purchase and use of the JB Thumbnail Preloader software offered via the website jonathanbesler.de. The provider and maker of the software is Jonathan Besler, Marktplatz 4, 87561 Oberstdorf, Germany (the "Provider"). Section 2 specifies your contractual partner for the purchase. Any deviating terms of the customer shall not apply unless the Provider expressly agrees to their validity.

2. Contractual partner and conclusion of contract

The presentation of the software on the website does not constitute a binding offer but an invitation to submit an offer. By completing the order process, you submit a binding offer to purchase.

In every country, the seller and your contractual partner for the purchase agreement is the Paddle entity responsible for your purchase location, acting as Merchant of Record. For purchases from the United States, this is Paddle.com Inc., 3811 Ditmars Blvd. #1071, Astoria, New York, NY 11105-1803, USA. For purchases from Canada, this is Paddle.com (Canada) Ltd., 22 Adelaide Street West, Suite 3400, Toronto, Ontario, M5H 4E3, Canada. For purchases from all other countries, this is Paddle.com Market Limited, 30 Old Bailey, London EC4M 7AU, United Kingdom. The entity responsible for your purchase is identified during checkout and in your order confirmation.

Paddle concludes the purchase agreement with you, handles payment, taxes and refunds, and issues the invoice. Paddle's terms apply to the purchase agreement. They are shown during checkout and available at paddle.com/legal/checkout-buyer-terms. Paddle confirms the transaction by email or another durable electronic format.

The Provider is your contractual partner for the licence and use of the software and your point of contact for questions about the product, the licence and support. These licence and usage terms apply in addition to the purchase agreement with Paddle.

3. Subject matter of the service

The subject matter of the contract is the granting of a licence to use the JB Thumbnail Preloader software. It is desktop software for the Windows operating system (Windows 10 or Windows 11, 64-bit in each case). Other operating systems are not supported.

The software is offered in the Free, Pro and Studio editions. The Free edition is free of charge and includes all supported file formats. The Pro and Studio editions are subject to a charge and can be acquired as a one-time purchase (lifetime) or as a subscription. The specific scope of features of each edition results from the product description on the website at the time the contract is concluded.

4. Prices and payment

All paid software licences are sold worldwide exclusively through Paddle. The total price shown by Paddle during checkout in your local currency, including the taxes applicable in your country, is decisive. Prices displayed on the website are retrieved from Paddle and are not a separate price source. The purchase price is due upon conclusion of the contract. The available payment methods are shown during checkout.

5. Provision and delivery

The software is provided as a download. You will receive the licence key to activate the purchased edition by email after successful payment. Provision is generally made immediately, but at the latest without culpable delay after receipt of payment.

6. Licence terms

By purchasing a paid edition, you receive a simple, non-exclusive and non-transferable right to use the software for your own purposes. The following applies:

  • Activation is limited to the number of devices stated in the product description.
  • The licence key must be kept confidential and must not be passed on to third parties or made publicly accessible.
  • Modification, decompilation or reverse engineering of the software is permitted only to the extent that the law mandatorily permits it and it cannot be effectively excluded by contract.
  • All rights to the software, in particular copyrights, remain with the Provider.

7. Trial version

A free 14 day trial with the full scope of the Studio edition can be started in the app through an email account using magic link sign in. No payment method is required and the trial does not automatically convert into a subscription. When the trial expires, the app automatically transitions to the Free edition.

The email account and hardware ID are checked independently on the server for previous trial use. If the trial has already been used for either one, there is no entitlement to another trial.

8. Subscription, term and cancellation

If an edition is purchased as a subscription, the subscription automatically renews for a further term of the same length after the selected term expires, unless it is cancelled in good time. You can cancel the subscription at any time with effect from the end of the current billing period through the Paddle buyer portal or the cancellation button on this website. For a one-time purchase (lifetime), there is no recurring payment obligation and no need for cancellation.

9. Updates

With a one-time purchase (lifetime), you receive updates for as long as they are offered for the purchased edition. With a subscription, you receive updates for the duration of the current subscription. There is no entitlement to the development of specific new features.

10. Right of withdrawal

Consumers have a statutory right of withdrawal. When the download is made available immediately, this right expires only under the statutory conditions. These include your express consent to performance beginning before the withdrawal period expires, your acknowledgement that you thereby lose your right of withdrawal when performance begins, the start of performance and a contract confirmation on a durable medium. 11. Warranty

The statutory provisions on warranty (liability for defects) apply. The software is provided in the condition described on the website at the relevant time. A specific suitability for the customer's purposes going beyond the product description is not owed unless expressly agreed.

12. Liability

The Provider is liable without limitation for damage arising from injury to life, body or health, for damage based on intent or gross negligence, and under the provisions of the German Product Liability Act.

In cases of simple negligence, the Provider is liable only for the breach of a material contractual obligation (cardinal obligation), the fulfilment of which is essential for the proper performance of the contract and on whose compliance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for simple negligence is excluded. No further liability exists.

13. Final provisions

The law of the Federal Republic of Germany applies to the licence and use of the software in relation to the Provider, excluding the UN Convention on Contracts for the International Sale of Goods. The Paddle terms provided during checkout apply to the purchase agreement with Paddle. If you act as a consumer, no choice of law may deprive you of the protection afforded by mandatory provisions of the law of your country of residence.

Should individual provisions of these Terms and Conditions be or become wholly or partly invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall take the place of the invalid provision.
