1. Subject matter
These terms govern the granting of rights of use in the software JB Thumbnail Preloader (the "Software") by Jonathan Besler (the "Provider"). The underlying purchase contract and the processing of payment are governed by the Terms and Conditions and are handled by the payment provider Paddle.
2. Scope of rights
The Provider grants the customer a simple, non-exclusive right to use the Software in accordance with the plan purchased. One license entitles the customer to install and use the Software on one device. The activation may be transferred by the customer to another device; simultaneous use on several devices requires a corresponding number of licenses.
The free plan may be used without time limit, including commercially, but only within the functionality of that plan.
3. Term
- Subscriptions run for the chosen period and renew automatically until cancelled. After the end of the paid period the Software reverts to the free feature set.
- Lifetime licenses apply without time limit to major version 1.x including all updates within that version line. There is no entitlement to future major versions; a discount of 50 percent is granted for a version 2.0.
4. Restrictions
The customer must not:
- reverse engineer, decompile or disassemble the Software, except where expressly permitted by law;
- pass on, publish, rent out or sell license keys;
- circumvent technical protection measures or the license check;
- distribute the Software under their own name or offer it as their own service.
A breach entitles the Provider to block the license key concerned.
5. Updates
The Provider makes updates available at its own discretion. Within a running subscription, and within the major version of a lifetime license, these updates are included at no additional cost. There is no obligation to continue development to any particular extent or on any particular schedule.
6. Warranty
The Software is provided in its respective current version. The Provider warrants that the Software substantially performs the functions stated in the product description. No warranty is given that the Software will run free of errors or without interruption, or that it is fit for any particular purpose. Statutory consumer rights remain unaffected.
7. Liability
The Provider is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In cases of simple negligence the Provider is liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. The provisions of the German Product Liability Act remain unaffected.
8. Data
The Software processes files exclusively on the customer's local device. Details on what the Software stores and which connections it makes are described under Data processing in the app.
9. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is an entrepreneur, the place of jurisdiction is the Provider's registered office. Should any provision be invalid, the validity of the remaining provisions is unaffected.
